State Restrictions
 
If your state is not listed under any of the restriction categories then there are currently no restrictions on Notary Signing Agents in your state.
 
 
The following states require an attorney that is admitted to the state bar to be present or involved in the closing of real property transactions:
 
1.  Deleware
2.  Georgia
3.  Massachusetts
4.  South Carolina
5.  Vermont
6.  West Virginia
 
 
 
The following states require a title insurance license for all closings/signings.
 
1.  Indiana
2.  Maryland
 
 
 
The following state restricts Notaries from conducting loan signing appointments without an escrow license if they ever handle monies for closing costs.
 
1.  Virginia
 
 
 
The following state allows Notary Signing Agents to notarize and obtain signatures on title escrow settlement documents, but if the Notary goes beyond this limited role, the Notary may be required to obtain an escrow license.
 
1.  Utah
 
 
 
The following state requries that Home Equity Lines Of Credit (HELOCS) be signed in the office of a lender, attorney, or title company. This restriction should not pose any real problems for Notary Signing Agents. Notaries in this state will simply need to sign the borrowers in the appropriate office when the loan documents being signed are for a HELOC.

The following states are in confilct as to whether Notary Signing Agents can conduct signings without being an attorney.

The following states limit the fees that Notaries are allowed to charge (to a statutory maximum). Please contact your secretary of state if you reside in one of these states to determine the exact amount you will be allowed to charge per signature notarized, and whether or not you will be allowed to charge travel fees, etc.
